file_icons/pdf1.gifCenter for Food Safety (+) Vs. USDA

Short Description:
At issue in this case is the Department of Agriculture’s decision to deregulate a genetically engineered (“GE”) variety of sugar beet that – unlike conventionally bred varieties and most plants – is able to tolerate the chemical glyphosate, the active ingredient in the powerful herbicide Roundup. Deregulation allows these “Roundup Ready” sugar beets to be grown and distributed commercially throughout the United States without permits, labeling, or other restrictions.

file_icons/pdf1.gifGaining Ground in the Courts

Short Description:
In a string of recent cases, the Center for Food Safety (CFS), representing and partnering with other non-profit consumer advocacy groups, environmental protection organizations, and numerous small farmers, has won hard-fought victories in federal court. Judges found that the environmental assessments done by the United States Department of Agriculture (USDA) prior to the testing or commercialization of several genetically engineered (GE) crops was either non-existent or severely lacking, and in violation of our nation’s environmental protection laws.

file_icons/pdf1.gifGeertson Farms Vs. Monsanto • May 3, 2007

Short Description:
By Memorandum and Order dated February 13, 2007, the Court concluded that the federal defendants violated the National Environmental Protection Act (“NEPA”) by failing to prepare an environmental impact statement (“EIS”) before deregulating alfalfa genetically engineered to resist the herbicide Roundup (“Roundup Ready alfalfa”). The Court held that an EIS is required because of the potential significant environmental impact of gene transmission; specifically, the acknowledged risk that the genetically engineered gene will “contaminate” organic and conventional alfalfa.
